Terms & Conditions


This agreement to rent vacation Property is by and between Carillon Beach Rentals, LLC (Company) and (Renter). Company and Renter agree that Renter shall rent the Property during the specified time, for the rent and fees indicated, upon the following terms and conditions: 



Rental rates and fees are not guaranteed and subject to change any time until reservation is confirmed. Renter understands payment and reservation terms and agrees to abide by same.  



All payments shall be made by debit card or credit card acceptable to Company. An Advance Rent Deposit shall be paid at the time of reservation confirmation. The remainder of the Rental Amount is due and payable by credit card not less than 31 days prior to Arrival Date. Renter will receive email confirmation of all applicable credit card charges debited to Renter’s credit card account. Only upon payment of the Advance Rent Deposit, coupled with return of this fully executed Rental Agreement, shall Renter’s reservation be deemed confirmed. 



If the Renter cancels this reservation on or before 60 days prior to the Arrival date, the Advance Rent Deposit shall be returned to the Renter minus a $200 processing fee. It is a firm Company policy that no cancellations are available to Renter requesting cancellation less than 60 days prior to arrival date. To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase Travel Insurance to afford an opportunity for refund of deposits paid and reimbursement of other vacation payments.  



After receipt of the full Rental Amount, and prior to arrival, the Company will provide the Property access code or key access to the door one week prior to arrival. IMPORTANT: The code and check-in instructions will be provided via email only. Renter is responsible for bringing these instructions at arrival and registering their vehicles with the Carillon Beach HOA Symliv system for main gate access. Failure to comply will likely result in delayed entry into the Carillon Community and the Property. Twenty-five dollars will be charged for missing keys.  



Check-in time is 4:00pm and check out time is 9:00am. Early check-in and late check out may be available upon request, depending on occupancy and cleaning status, for an additional $75 fee and subject to Company approval. Early arrivals are not considered during the Summer season. You will be notified when your rented home has been cleaned and ready for occupancy.  



Household linens are not to be removed from the Property. An initial supply of paper products, trash liners, bathroom tissue and soap is provided. Beach towels are also provided for our guests. Refills, as required, are the responsibility of Renter. An inventory of the number and quality of linens is recorded before and after departure of each guest. 



  1. SPRAY suntan products may not be applied in the Property. 
  2. Outdoor showers are provided to remove sand before entering the beach house. 
  3. Renter shall leave the Property in GOOD ORDER. 
  4. During Renter stay at Property and at departure, Renter shall remove ALL TRASH to garbage cans. 
  5. Upon departure, Renter shall leave sheets on beds and used towels in the laundry area. 
  6. Upon departure, Renter shall load the dishwasher and start. Cleaning time is approximately 45 minutes for each bedroom of the Property (e.g. 3 bdr takes 3 hrs to clean, 2 bdr takes 2 hrs to clean, etc.). If House Keeping is required to significantly exceed the allotted time, Renter shall be charged $75 per extra hour taken to clean which amount will be charged to the credit card on file. Time spent shall be rounded up to next full hour. 



All rental and deposit monies will be forfeited, and the Renter will be asked to vacate the Property immediately and/or incur extra charges, for a breach of this Agreement, which breach includes, but is not limited to, failure to adhere to any of the following rules and regulations applicable to the Property: 

  1. Absolutely NO SMOKING of any kind inside the Property or from the decks or balconies. 
  2. Pets are NEVER allowed inside the Property or on the site. 
  3. Large parties or excessive noise are not allowed. Carillon Beach Community rules and regulations are provided at the guard gate upon entrance to Carillon. 
  4. The number of people occupying the Property may not exceed the maximum number designated on Page 1 of this Rental Agreement. 
  5. Renter may not have or use fireworks, firecrackers on the Property or anywhere within Carillon Beach. 
  6. No furnishings, fixtures, or equipment from the Property may be removed. 
  7. Windows and doors may not be left open as this may cause the HVAC units to freeze up and fail to work properly along with the sea air damaging the interior of the house. 
  8. No markers please. Bring crayons or pencils for children to color. 
  9. All applicable governmental laws and ordinances as well as Carillon Beach Association rules and covenants must be observed. 
  10. Renter may not assign or sublease all or part of this Agreement and Property.  



Accidental damages up to $300 are covered by the one-time damage waiver fee. Any damages that are deemed NOT accidental or which result in a repair cost exceeding $300 will be charged to Renter’s credit card on file. (See attached damage waiver fee terms and conditions.) If evidence of smoking or pets is found in the Property, an additional $250 will be charged to the Renter. 



Renter is renting a privately owned home or condominium. While Company attempts to maintain all rental properties to the highest standards, from time-to-time maintenance issues may arise. Company will address these issues as soon as practicable after notification. Renter shall not be entitled to a refund or credit for the inconvenience of a mechanical failure or utility outage. However, if an issue is reported and maintenance determines the issue is the fault of the Renter, Renter may be held liable for the cost of repair, service, parts, and/or labor. 



Company may enter the Property at any time for any reason upon giving reasonable notice. Company will attempt to notify Renter with at least 24 hours notice of Company’s intent to enter except in case of emergency, Renter report, or complaint requiring more urgent attention. 



Renter understands that Owners and Company policy prohibit rental of Property to vacationing groups of students or singles under the age of 30. Reservations made under false pretenses subject Renter and all guests of Renter to eviction and forfeiture of all monies paid. 



The Carillon Beach Community pools are private; there are no lifeguards on duty. All pool decks, steps and other areas of the Property can be slippery when wet. Renter shall ensure that Renter and Renter’s guests take responsibility for their own safety, by among other things, limiting alcohol intake. The Renter assumes the responsibility that Renter and all guests will strictly observe all pool rules. The Renter understands and assumes the risk that failure to abide by pool safety rules constitutes a breach of this Agreement, which also can cause serious injury or death. 



Company and Renter agree that should Property be destroyed by fire or other casualty so as to become unfit for human habitation, this Agreement shall immediately terminate, and Company will prorate and refund unused rent. 



Company is not liable for Renter’s Property left behind or for any compensatory, consequential, incidental, special, punitive, exemplary or indirect damages from any cause whatsoever, regardless of whether they were foreseeable by Renter or Renter’s guests. Company’s maximum aggregate liability arising out of the rental of the Property to Renter is limited to the rental amount paid by Renter during the Rental Period. The Company is not undertaking to provide security and is not responsible for loss or theft of the Renter’s Property. 



Renter agrees to indemnify and hold harmless, the Company and its officers, members, contractors and representatives from all liabilities, claims, actions, and causes of arising out of Renter’s rental, occupancy and/or usage of the property, including damages or injuries alleged to be caused by company, Homeowner, or third parties. 



In the event that either party brings any action or proceeding to enforce any term, covenant or condition of this agreement, then the prevailing party in such litigation shall be entitled to recover from the other party reasonable attorney’s fees to be fixed by the court in such action or proceeding. Furthermore, Renter agrees to pay the attorney’s fees and litigation expenses of Company if Company is made a party to any third party litigation. 



This Agreement will be governed by the laws of Florida, without regard to conflicts of law principles. Company and Renter agree that any legal action must be brought in Bay County, Florida. 



This Agreement constitutes the entire agreement between the parties and there are no other promises, terms or conditions, whether oral or written, other than contained herein. These Terms and Conditions may be modified only in writing signed by both parties. 


I agree and understand that this is a legally binding document and I have read all terms and conditions in this document. 







A nonrefundable Damage Waiver Fee is required for all Carillon Beach Rentals, LLC vacation rental reservations. Lessor requires a valid credit card number on file in addition to payment of the Damage Waiver Fee. The Damage Waiver Fee is a nonrefundable Fee which relieves Lessee of the repair/replacement costs associated with certain unintentional and incidental damage to the Rental Property and its contents, not to exceed the sum of $300.  The Damage Waiver Fee does not apply to, and specifically excludes, intentional damage, or loss caused by theft, smoking, unauthorized entry into the owner’s supply closet, pets permitted inside the vacation rental property by the lessee or guests of lessee.  Further, the Damage Waiver Fee does not apply to abuse/neglect of the rental property requiring extraordinary (beyond normal and customary) cleaning services at check-out. Lessee is expected to honor occupancy limits for the vacation property being rented as well as parking limits, Community rules and regulations and policies set forth in in Lessor’s Rental Policies and Rental Agreement.  The Damage Waiver Fee does not apply to or cover fines imposed upon Lessee or guests of Lessee, Carillon Beach Rentals, LLC, or its Manager by the City, County, State, or Homeowner Association as the result of violation of any law, ordinance, rule or regulation. Lessee will be notified of any Excess Damage Costs (costs above $300 or costs for excluded items) in writing. Any Excess Damage Costs will also be charged immediately to Lessee’s credit card. Lessee, by signing below, gives consent to such charges and assumes full responsibility for any items found to be missing after Lessee’s occupancy of the rental property and any damage due to misuse, negligence or act by Lessee’s or Lessee’s guests. In the event Lessee finds damage to the property upon check in, Lessee shall report such damage to the Property Manager within 24 hours of check-in. Failure to timely report such damage existing at the time of Lessee’s occupancy will result in such damage being attributed to Lessee’s occupancy. 


The Damage Waiver Fee does not substitute for Lessee’s responsibility to respect The Property and leave it in appropriate condition as it existed upon check-in by Lessee. The Damage Waiver Fee neither negates Lessee’s duties as a responsible renter nor relieves Lessee from responsibility for intentionally destructive acts of Lessee or other members of Lessee’s party while in occupancy. Lessee must notify Lessor of any damage or theft to the unit during Lessee’s occupancy or upon vacating. The Property will be carefully inspected after Lessee’s departure and any damage, theft or other incidents which occur during Lessee’s occupancy, and which have not been disclosed to Lessor prior to Lessee’s leaving will remain Lessee’s obligation. 


By renting and occupying this property Lessee acknowledge that Lessor has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the waiver of liability described herein. The Lessee must report any theft or damage to The Property or its contents prior to checkout or any otherwise applicable damage waiver will be void. 


TERM OF COVERAGE: The waiver takes effect upon check-in on the booked arrival date to The Property, together with receipt of payment of the waiver fee. All coverage shall terminate upon normal check-out time of The Property or the departure of the Covered Lessee, whichever occurs first.

GUARD GATE ENTRANCE PROCEDURE AND HOA PARKING POLICY: The Carillon Beach HOA has implemented a QR code entrance procedure for renters at the main entrance. 


All vehicles must register and pay a $35/vehicle parking fee to enter Carillon Beach. Upon registration, you will receive a QR code that you will use at the entrance scanner. 


Here is the procedure to register.  

  1. After confirming your reservation, you should have received an email from Carillon Beach Community Access Pass to complete your vehicle registration process.  
  2. Open the email and fill out the information for each vehicle you plan to park in the community. Be prepared to enter your vehicle’s license plate number.   
  3. Pay the $35 fee per vehicle. Registration is good for the entire duration of your reservation.  
  4. Save the QR code on your mobile device and scan it at the guard gate scanner when you arrive in Carillon Beach, and every subsequent entrance. 
  5. Every vehicle you bring will need to register and pay the fee. 


HOA PARKING POLICY: 1 Vehicle or Golf Cart may be parked in the gravel in front of a home and other vehicles parked in the driveway. Golf cart charging must take place in the driveway – not on gravel. 


MOTORIZED VEHICLES: All drivers in Carillon Beach must have a valid driver’s license. Permits are not acceptable. This requirement includes scooters and golf carts. Vehicles may NOT be parked on vacant lots. Streets must be kept clear at all times for emergency vehicles. Parking is allowed in gravel areas unless otherwise posted. DO NOT block driveways, and park only in front of the driveway of the home you are occupying. All vehicles must display either an owner’s decal or a guest pass. Guest passes must be visibly displayed on the dash at all times. Unauthorized vehicles will be towed at the owner’s expense. Buses, boats, RV’s and trailers (including motorcycle trailers and golf cart trailers are NOT allowed). 


RENTAL GUESTS: Please note any additional guests expected at the property must be cleared in advance by the Owner or Property Manager.  


COMMUNITY SWIMMING POOLS: Pool hours are from 9:00am to 10:00pm daily. 

There are no lifeguards. Owners and guests swim at their own risk. Children under fourteen (14) years of age must be accompanied at all times by a parent or adult. Carillon Beach has three (3) pools – Beach Club Pool, Lake Carillon Pool, and the Bellview Park Pool. The Bellview Park Pool is heated when the water temperature falls below 85 degrees. From time-to-time pools may be closed for maintenance. Pool furniture is for the rest and relaxation of our owners and guests only. All pool furniture is to remain in the designated pool areas. Chairs and lounges cannot be “reserved” by placing towels on them. Children who are not potty trained will be allowed to swim ONLY at the Bellview Park Pools. Children who are not potty trained must wear swim diapers and properly fitted plastic panties. 

  1. NO diving, including “cannonballs”, running, pushing, wrestling, foul language, or undue disturbance shall be permitted in or about the pool area. Only small balls made of soft materials may be used at the pool. 
  2. NO floats, footballs, or sharp objects are allowed in the pool. 
  3. SMALL coolers only are allowed at the pools. 
  4. NO GLASS or other breakable containers of any kind are allowed in the pool areas. 
  5. NO SMOKING is permitted in the pool areas. 
  6. NO PETS are allowed in the pools. 
  7. Food and drink are NOT permitted in the pool or within 4 feet of the pool edge. 
  8. Bicycles and skateboards are not permitted in the pool area and must not block the pool entrance or sidewalk. 
  9. All trash must be placed in the containers provided. 
  10. Use of barbeque grills in the pool areas is prohibited.  


BEACH ACCESS: Homeowner walkovers are private. Please access the beach by using one of Carillon’s eight (8) walkovers located along Beachside Drive. 


BEACH: Bay County Ordinance prohibits GLASS containers on the beach. Camping is prohibited on the beach. Tiki torches are prohibited on the beach per the Turtle Ordinance. Tents are NOT allowed. Shade tents are an exception but may not exceed 10’x10’. All items taken to the beach must be removed before dusk. Items left at the beach will be collected and discarded. Please fill in any holes before leaving the beach. 


BEACH SERVICES: Beach lounges and umbrellas are available for rent from La Dolce Vita’s service. Call 866-651-1869.  


BAR-B-Q GRILLS AND BONFIRES: Due to the proximity of the houses, open flame or charcoal grills present a significant fire hazard. Do not leave grills unattended. Bonfires are prohibited anywhere in/on Carillon Beach. 


GARBAGE: All garbage must be in plastic bags. Normal garbage pickup days are Monday, Wednesday, and Friday in the morning. Garbage is picked up every day except Sunday during Spring Break and Summer. 


FIREWORKS: Fireworks are prohibited in or on Carillon Beach per Florida Statute 791 Rule 4A-50. 


HORSESHOES: Horseshoes are not allowed on the Village Green or Bellview Park. 


PETS: Bay County DOES NOT ALLOW PETS ON THE BEACH. Inside the community, pets are required to be on a leash. Pets may not cause a disturbance or annoyance. Each owner or guest shall be responsible for the proper disposal of pet waste. For your convenience, pet waste stations are placed throughout the community. 


MISCELLANEOUS: No sign, advertisement or notices of any type shall be erected or displayed in or on Carillon Beach. Towels, swimsuits, or similar items are not to be hung over the railings or displayed from the exterior of any dwelling. 


TURTLES: Sea turtle nesting season is from May 1 until November 1. It is illegal to disturb nesting turtles or hatchlings. If you see a nesting turtle or hatchlings, please call the 24-hour hotline at 888-404-3923 to make a report. 


GOLF CARTS: Failure to observe the Association’s rules or reckless operation of a golf cart will result in fines as allowed by the Association Documents and the removal of the golf cart from the property. Drivers must have a valid driver’s license. Golf carts in use between sunset and sunrise must be equipped with headlights and taillights. All passengers must remain seated at all times. The number of passengers on a cart cannot exceed the number of seats on a cart. Operation of golf carts is restricted to streets and may not be driven on sidewalks, grassy areas, or sand dunes. Speed limits and STOP signs must be obeyed. Guest personal golf carts must be registered with the Association office prior to arrival. To register a guest golf cart, please have available: a copy of the guest’s drivers license, a copy of their auto insurance, the golf cart’s serial number, the name of the home the guests are staying in and departure date. This information can be provided via FAX (850) 234- 6258 or via email at rob@carillonbeach.com. A guest pass will be left at the guard gate for pick-up upon arrival. If golf cart registration is not done prior to arrival, guests are to call property patrol at (850) 596-1537 to obtain a temporary pass until the office is open. 


TENNIS COURTS: Carillon Beach has two tennis courts located on Cottage Court. Nighttime tennis is not available. Please limit playing time to two (2) hours. Leaning on, striking, jumping over, or sitting on the net is prohibited. No abusive language or behavior will be tolerated. No smoking, food, or open beverages are permitted inside the court area. Bicycles, roller skates, roller blades, and skateboards are NOT permitted on the tennis courts. Pets are not allowed on the tennis courts. 


BASKETBALL COURT: Carillon Beach has one basketball court, which is located, by the children’s playground. The basketball court closes at 10 PM. Please limit playing time to two (2) hours. No abusive language or behavior will be tolerated. Hanging from the rim of the hoop or the net is prohibited. Smoking is prohibited at or around the basketball court. No food or open beverages permitted. Bicycles, roller skates, roller blades etc. are NOT permitted on the basketball court.
